Legislation Affecting Utilities

A state government authority, the New York State Energy Research and Development Authority (NYSERDA), administers and implements sets of statewide programs for customers, including residential, multifamily, low-income, commercial/industrial, and research and development programs, collectively known as "New York Energy $mart™," with funding from system benefits charges to customers of the state’s regulated electric distribution utilities. 

The New York Public Service Commission (PSC) adopted a renewable portfolio standard (RPS) in September 2004. New York's RPS had a target of 25% by 2013, but was expanded in January 2010 to 30% by 2015 by order of the PSC. Of this 30%, approximately 19.3% of the target will be derived from existing renewable energy facilities and one percent (1%) of the target is expected to be met through voluntary green power sales. The remainder will be derived from new, eligible resources centrally procured by the New York State Energy Research and Development Authority (NYSERDA).

The New York Public Service Commission’s (NYPSC’s) June 2008 Order Establishing Energy Efficiency Portfolio Standard (EEPS) and Approving Programs (Case 07-M-0548) creates a standard for the state’s investor-owned utilities with three-year targets for energy savings with a goal of reducing the state’s energy consumption by 15% by 2015.

Relevance to Public Power:  New York’s RPS does not apply to public power. The PSC is considering whether to set specific energy efficiency targets for municipally-owned utilities under PSC jurisdiction.

Standards for Appliances

New York appliance efficiency standards legislation, enacted in 2005, covers the following products offered for sale in New York not preempted by federal standards as of March 2010.

Climate Change Action

On August 6, 2009, Executive Order No. 24 (2009) was signed setting a goal of reducing the state’s greenhouse gas emissions 80 percent from 1990 levels by 2050.

On November 9, 2010 the New York State Climate Action Plan Interim Report was released.

Renewable Energy/Energy Efficiency Resource Standards
  • Long Island Power Authority: As part of its 2004-2013 Energy Plan, LIPA stated its intention to comply with the state’s renewable portfolio standards. In May 2008, LIPA announced a second 10-year program –Efficiency Long Island – to begin in January 2009. The program aims to reduce peak demand by 500 MWs by 2018.
  • New York Power Authority:  NYPA has committed to cutting energy use by 15% by 2015.
